Overview:

This course covers worker classification, primarily in the context of nonprofit organizations. Among the topics covered are the Department of Labor's role in wage and hour laws (specifically the Fair Labor Standards Act), and the IRS's 20-part test for determining worker classification. It explains the complex interpretation of worker classification and how that varies among courts, and how the changing landscape of the workforce adds further complexity. Other topics covered include the potential consequences of misclassifying workers as independent contractors including unpaid overtime wages, liquidated damages and unpaid benefits, and best practices for mitigating the risk of worker misclassification.
